DEI, while well-intentioned, was always bound for the Supreme Court, because it is discriminatory in legally described ways – race, gender, religion…

We do still need it though. The causes of worse outcomes for people of certain races are multitude, and working out how they all add up is as complicated as weather forecasting. But as long as those outcomes are worse, then we only have two ways fix it. Give them some advantages, or determine that it is their own fault (for example, they are naturally or culturally lazy). Those are the binary views in the US.

Maybe there is a third way, by side-stepping what is legally discriminatory?

Here are some examples of what are not illegal in terms of discrimination:

  • Scholarships provided by individuals, to individuals
  • Scholarships which do not state criteria
  • Cultural – we prefer someone who understands the culture of the business, for example restaurants
  • Anything based on poverty, or homed status
  • Sporting ability
  • Any disability

Looking for examples of MAGA discrimination? Well, of course, Trump demands loyalty to him, specifically. No law against it (well, not tested yet).

Black Rifle Coffee – only hires veterans.
Year Up – only trains people without college degrees.

The answer is obvious – find aspects of those you want to hire that are outside of discrimination laws. For example (this is a terrible example), have a work place that has a rap culture and only hire people with a demonstrable knowledge and love of rap music.

DEI (diversity, equity, inclusion) approached things by deciding who was disadvantaged, and then directly offering those very same groups some help or advantages to help them get more equal outcomes in society. It correctly identified that “everyone has the same opportunity) was not actually reality based on income and wealth inequality, past and continuing racism, and hiring biases whether they are intentional or not.

For the most part it was positive. For the most part, standards were not diminished, because for the most part their is a standard that must be achieved or demonstrated, and no actual need to hire the best of the best.

However, as with most of woke (see crime in California, and transgender children), it went too far and so there has been a massive backlash, led by Trump.

That does not mean the end to DEI, it simply means that we (I’m a lefty) need to get smarter.

I recently went to a Lebanese Charcoal Chicken restaurant and all the staff were (to my eyes) Lebanese. Hooters in the US has specific requirements. These are allowed! The Lebanese restaurant – part of a chain – says it is Lebanese and therefore they can simply ask prospective staff if they have a knowledge and understanding of Lebanese culture. That is not racist, that is culturist, and not illegal. A movie studio will only hire a giant to play a giant…

Want to smoke in a restaurant, form a private club just for smokers.

Want to exclude transvestites from a women-only gym? Have a vagina-requirement.

Now with DEI 2.0, you just need to change the language, not the outcomes.

  • Make use of individual scholarship funds not controlled by the school
  • Talk about culture, not race (race is probably harder to define/prove anyway)
  • Talk about alternative cultures and not gender identity
  • Treat neurodiverse people as being more skilled at types of tasks
  • Treat age as experience
  • Have pathways through clubs or organizations that typically have the diversity you seek, making it indirect

While politics is typically a case of finding a median between two extremes (often swinging back and forth with election cycles), woke-ism has no happy median, it is divisive. But that is because so many people have a decide to side with the righteous side, and don’t really want a solution.
Non-binary solutions are often not hard, just require a more open mind, and some give-and-take.

Christmas

Woke people say “happy holidays”
MAGA people say “merry Xmas” because god dammit the US is a Christian land!
You can actually say both. “Merry Xmas and Happy Holidays”. Everybody is included, the dominant force is recognised, and no need to be upset. Nobody will force you to say the “happy holiday” bit, but polite people will understand why, just like please and thank you. It shows respect for others.

Pronouns

There are only really two aspects to this. One is greeting people you don’t know, or thanking them, with “sir” or “madam”. Easily fixed, just get out the habit of saying it. Instead of saying “thank you sir”, just say “thank you”. Problem solved, nobody can get offended.
The other is if you will be spoken about publicly, like a well-known person, or someone with a public-facing role in business or society. They should have a media presence that mentions their pronouns, only if they are not the common ones. Just like pointing out to journalists that Ralph Fiennes is pronounced “Rafe”.
Regular folk don’t need to tell us their pronouns, because they won’t be used anywhere they will hear it.
